Chad E. Nydegger

With over two decades of experience, Chad Nydegger is both a first-chair litigator and intellectual property prosecution portfolio manager. His practice focuses on all aspects of intellectual property enforcement and defense including litigation before federal and state trial and appellate courts,  trademark opposition and cancellation proceedings before Trademark Trial and Appeal Board, and patent validity challenges before the Patent Trial and Appeal Board. Chad ensures each client understands and is able to navigate the specific intellectual property issues confronting him or her and how those issues play into their overall business and IP portfolio goals and strategies.

Chad’s litigation experience includes representing clients to assert and defend against claims of patent infringement, trademark infringement, theft of trade secrets, false advertising, unfair competition claims, copyright infringement, and related contractual disputes. He also represents clients in inter partes reviews and trademark oppositions and cancellations before the U.S. Patent and Trademark Office.

On the prosecution side of the practice, Chad’s work includes the preparation, filing and prosecution of trademark applications.

From 2004 to 2005, Chad served as Law Clerk to Honorable Judge Randall Rader on the U.S. Court of Appeals for the Federal Circuit.

  • Puradigm, LLC v. DBG Group Investments, LLC, et al., Civil Action No. 3:23-cv-0216 (N.D. Tex., Aug. 29, 2024) (obtained summary judgment dismissing claims of patent infringement of U.S. Patent No. 8,585,979)
  • Vitamins Online, Inc. v. Heartwise, Inc., 71 F.4th 1222 (10th Cir. 2023), (as lead counsel obtained affirmance of an award of disgorgement of defendant’s profits of over $9 million plus attorneys’ fees, and remand for the district court to consider awarding punitive damages and injunctive relief)
  • Humboldt B.V., et al. v. Lornic Design, Inc., Civil Action No. 1:17-cv-983 (W. Dist. Michigan, Sept. 9, 2019) (obtained order in favor of plaintiff granting summary judgment of infringement of U.S. Pat. No. 9,433,225)
  • Wasatch Medical Group, LLC v. Mark Saunders, et al., Civil Action No. 190901641 (Dist. Utah 2019) (Lead counsel: defended against claims of theft of trade secret; strategy resulted in a “walk-away” settlement without defendants having to answer the complaint)
  • Nox Medical Ehf v. Natus Neurology Inc., Civil Action No. 1:15-cv-00709-RGA (Dist. Delaware 2018) (Lead counsel: jury verdict for plaintiff finding willful patent infringement and no patent invalidity; bench trial verdict for plaintiff finding no unenforceability of U.S. Pat. No. 9,059,532 for inequitable conduct)
  • Natus Neurology Inc. v. Nox Medical Ehf, IPR2016-01822 (PTAB March 21, 2018) (Lead counsel: decision for patent owner upholding the validity of all challenged claims of U.S. Pat. No. 9,059,532 in inter partes review)
