This privacy policy (“Policy”) and notice at collection explains Workman Nydegger’s adherence to industry standards for the protection of personally identifiable information as applied to information collected from visitors to Workman Nydegger’s website(s) as well as from or in connection with individual client contacts (including those of prospective and former clients), business contacts, and potential employees (altogether hereinafter “consumers”). By using this website or sharing personally identifiable information with Workman Nydegger employees or agents, you are consenting (where allowed by applicable law) to the practices described in this Policy and acknowledging our disclaimer, available here.
California Notice at Collection
The California Consumer Privacy Act (CCPA) provides for certain notices regarding the use of applicable consumers’ personal information. The following is intended to provide these notices.
In the course of conducting our business we may collect personal information. A list of the categories of personal information we collect and the purposes for which the information is used are available below in Sections 1 and 2. We do not sell your personal information to others, as further addressed in Sections 2 and 3.
Privacy Policy
1. Information Collection and Use. Workman Nydegger collects information necessary to provide the services that you or others seek (including legal services, providing responses to communications, or assessing qualifications for employment) and/or any information that you choose to share with us or authorize us to access. This may include name and personal identifiers, contact information such as email or mailing addresses and phone numbers, business or commercial information, billing and payment information, ownership or employment information (including where you act as an agent or representative for a client or prospective client), resume and reference information, background check and qualification assessment information, and any other information pertinent to your matter. Where you share the information of others with us, including the information of employees, consumers, and/or other contacts, you are responsible for informing affected individuals of this Policy. We may also receive personal information from other sources such as third parties or publicly available sources.
Workman Nydegger also collects information on this site at two different stages. First, we collect anonymous, aggregate information (such as domain name or IP address) from all visitors to the site. This type of information is never linked to any personally identifiable information and is only used in the aggregate to generate statistical reports about the use of our site. Second, we require the submission of certain personally identifiable information when you use services available on the site. You will be informed at the point of collection what information is required for such services. For example, we collect the contact information you choose to provide us with when you submit information via the online contact form.
Workman Nydegger only collects sensitive personally identifiable information (such as data revealing applicable forms of identification, racial or ethnic origin or sexual orientation, religious beliefs, union membership information, contents of relevant messages, genetic or biometric data,
health data including mental or physical health diagnoses, citizenship or immigration status, etc.) where we have your consent and/or (where applicable) if it is necessary for one of the purposes described in Section 2 below. For more on applicable rights here, see Section 9 below.
2. Use of Your Personal Information. Workman Nydegger does not sell, rent, or share site user information to or with any third party not affiliated with or owned by Workman Nydegger, except that we may disclose such information to service providers who may assist us in providing our site’s services to you (such as third-party payment processors) or in such areas as data storage. Workman Nydegger will never sell your personally identifiable information or share it to be used for purposes such as targeted advertising or sending you unsolicited commercial offers from any third party. Workman Nydegger does not use automated decision-making technology to make significant decisions concerning any consumer.
Workman Nydegger may use personally identifiable information for any of the following purposes:
- Offering, providing, and/or facilitating our services;
- Communicating with you about or in connection with our services (including any opportunities and events reasonably connected with them);
- Processing and/or responding to inquiries;
- Establishing and/or maintaining a business or contractual relationship with you;
- Conducting background or conflict checks for new, current, or prospective clients;
- Identifying and/or evaluating you and your qualifications for employment positions, including through background checks;
- Coordinating, obtaining, and/or processing payment for services;
- Accounting or tax purposes;
- Communicating with any insurance companies that provide or may provide us with insurance coverage in relation to our services;
- Internal statistics and business functions;
- Conducting or hosting (in part or in connection with others) both in-person and online events;
- Promoting our services (only where applicable under our agreement with you);
- Establishing, exercising, or defending legal rights;
- Compliance with applicable laws, rules, regulations, legal obligations, and industry standards.
Workman Nydegger may use personally identifiable information in other ways which are disclosed at the time you voluntarily provide applicable personally identifiable information.
Workman Nydegger will only retain personally identifiable information for so long as required by law and/or as is reasonably necessary for or in connection with the purpose for which it was provided or collected, including during applicable statues of limitations, as required by our internal document retention policy, and/or for any other legitimate purposes.
3. Disclosure of Personal Information. We will disclose personally identifiable information when required by law, or if we have a good-faith belief that such action is necessary to comply with applicable judicial, legal, administrative, or prosecution proceedings, a court order, or legal process
served on us. We will otherwise disclose personally identifiable information to third parties only as requested by you or as necessary to facilitate the uses set out in Section 2 above. This may include disclosure of applicable information to third parties such as data storage and file management providers, insurance providers, payment processors, accountants, background check providers, judges, court personnel, opposing parties and their personnel, mediators, arbitrators, the USPTO and its personnel, and any other applicable regulatory, legal, or governmental authorities. Personally identifiable information may also be disclosed in connection with a business transition as set out in Section 5 below.
As noted above, Workman Nydegger will never sell your personally identifiable information or share it to be used for purposes such as targeted advertising or sending you unsolicited commercial offers from any third party.
4. Personal Information of Children. Workman Nydegger complies with applicable laws, including the requirements of the Children’s Online Privacy Protection Act (COPPA) and the FTC’s Rule interpreting COPPA (16 CFR § 512). This site and our services are not directed to children, and we do not knowingly collect any personally identifiable information from children under 16 years of age through this site or, in general, without parent or guardian consent as required under applicable laws. If we determine that personally identifiable information has been inadvertently collected on anyone under 16 without the necessary consent, we will immediately take steps to ensure that such personally identifiable information is deleted or, in the alternative, that the necessary consent is obtained for the use and storage of such personally identifiable information. Any children or minors as defined under applicable law must seek and obtain parent or guardian permission to use this website or avail themselves of Workman Nydegger’s services.
In the unlikely event collection of a child’s personally identifiable information is necessary for providing our services as described herein and authorized by the parent or guardian, the parent or guardian may exercise any applicable rights set out in Section 9 below on the child’s behalf.
5. Business Transitions. In the event Workman Nydegger goes through a business transition, such as a merger, acquisition by another company, or sale of a portion of its assets, our consumers’ personal information may be part of the assets transferred. Consumers and other interested persons will be notified via at least prominent notice on our site for 30 days prior to a change of ownership or control of their personal information. If, as a result of the business transition, your personally identifiable information will be used in a manner materially different from that stated at the time of collection, you will be given a choice as to whether or not we may use your information in this different manner consistent with Section 10 below (Notification of Changes).
6. Cookies and Related Technologies. When you visit our website, Workman Nydegger may send cookies to your device or leverage various similar technologies including website applications, pixels, beacons, tags, etc. (hereinafter collectively “cookies”) to serve you. While the exact cookies can change from time to time, the applicable categories of cookies we (or third-party providers we work with) use are only those strictly necessary to operate the website.
We do store aggregate information that we collect through log files to help us better understand how our site is used and accessed. Log files record internet protocol (IP) addresses, browser types, internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of
clicks to analyze trends, administer the site, track a consumer’s movement in the aggregate, etc. This information is not linked to any personally identifiable information. It is used solely for internal purposes and/or to help us improve the experience of visitors to our site. Workman Nydegger does not respond to Do Not Track signals, in part because no common industry standards for handling such signals have been adopted.

7. Third Party Links. This website contains links to other sites. Workman Nydegger is not responsible for the privacy practices or content of these other sites and you visit them at your own risk. We encourage you to be aware when you leave our site and to read the privacy statements of each and every website that collects personally identifiable information. This privacy statement applies solely to information collected by our site.
In addition, your browser may already contain cookies placed by third-party sites. Workman Nydegger is not responsible for personally identifiable information such cookies may collect or what they may do with it. Nor is Workman Nydegger responsible for any personally identifiable information collected by third parties’ cookies from sites other than Workman Nydegger.
8. Security. Workman Nydegger takes commercially reasonable precautions to protect your information. However, given the nature of the Internet and the fact that network security measures are not infallible, we cannot guarantee the security of information submitted through the site. We also make an effort to protect your information off-line. Access to users’ information is restricted in our offices. The servers that store your personally identifiable information are housed in a secure environment. 9. Your Privacy Rights. You may have certain rights under various data privacy laws, where applicable. These rights may include the right to know about personally identifiable information collected about you, which information is in part provided herein. They may also include the right to access your collected personally identifiable information (including, where applicable, a list of third parties your personally identifiable information has been disclosed to), the right to have your personally identifiable information deleted (though some exceptions may apply) or corrected (if inaccurate), the right to data portability, the right to restrict processing of your personally identifiable information (including to limit use and disclosure of sensitive personally identifiable information), the right to withdraw consent (where applicable), and the right to opt-out of certain processing (including the right to opt-out of the sale or applicable sharing of your personally identifiable information). They may also include the right to opt out of or question automated decision-making and profiling, and the right to non-discrimination, which means that you cannot be discriminated against because you exercise any of your applicable rights. Workman Nydegger will not discriminate against you because of your exercise of your rights.
To exercise any of your rights or to ask which rights are applicable in which areas, such as Colorado or California, please contact us (or have your authorized agent contact us) at info@wnlaw.com or as set out below in Section 11. Upon receiving a valid request under this Section, and depending on which of your right(s) you wish to exercise, we may ask that you provide sufficient verifying

If your request is denied or if you feel that your personally identifiable information has not been handled appropriately according to applicable law(s), you may have the right to appeal that decision. 10. Notification of Changes. If we decide to change our Policy, we will post a notice on the main page of our website and/or other pages, where required, to alert you about the change. Where required by applicable law, we will also notify affected consumers of any material changes to this Policy and/or provide a reasonable opportunity to withdraw consent for materially different processing of previously or prospectively collected personal information.
