David P. Johnson

David P. Johnson is an intellectual property litigator who represents clients in patent, trademark, trade secret, copyright, and unfair-competition disputes. He helps brand owners, patent holders, and e-commerce businesses enforce valuable rights, defend against infringement claims, and resolve business-critical IP disputes efficiently.

His litigation practice includes federal-court actions and proceedings before the Trademark Trial and Appeal Board and Patent Trial and Appeal Board. He has represented clients in trademark oppositions, cancellation matters, patent infringement disputes, trade secret and unfair-competition litigation, and marketplace enforcement matters. He has significant experience with Amazon Patent Evaluation Express (APEX) proceedings and understands the interplay of APEX proceedings with parallel district court litigation. He also regularly serves as local counsel, helping national trial teams navigate Utah practice, procedure, and case strategy.

Dave has substantial experience with emergency-relief proceedings, representing both plaintiffs and defendants. His appellate experience includes winning a reversal in an administrative-procedure dispute and in a TTAB appeal for a major e-commerce brand.

Dave advises clients on the full lifecycle of their trademark portfolios, both domestically and abroad. He has managed hundreds of trademark applications and counsels on clearance, registration, portfolio development, licensing, enforcement, and IP due diligence. His work includes assessing IP issues in connection with new product lines, acquisitions, divestitures, and technology-transfer arrangements.

Dave also advises clients on data protection issues in connection with various laws. He helps clients assess legal obligations and risks, including presenting company-wide trainings, drafting and reviewing privacy and retention policies, and mitigating risks associated with cross-border data transfers.

As a registered patent attorney, Dave brings patent-prosecution experience and an engineering background to complex IP disputes and business counseling. He is regularly recognized in publications such as Chambers USA, The Best Lawyers in America, the WTR 1000, and Mountain States Super Lawyers.

Dave is also an adjunct professor at the University of Utah S.J. Quinney College of Law and has directed the local IP Moot Court competition between the University of Utah and Brigham Young University for more than a decade.
