Brian N. Platt

Brian’s practice focuses on the protection of intellectual property rights, including patents, trademarks, trade secrets, and copyrights. Managing high-stakes patent litigation matters around the world, including the United States, Germany, the Netherlands, and China, Brian’s experience encompasses litigating numerous patent and technology matters in the areas of video and streaming, computer systems and software, and content security, and anti-counterfeiting.

As a former in-house Director of Litigation for Kudelski SA (SIX: KUD), Brian focuses not only on litigation matters, but on creative business solutions to underlying disputes. As a result, clients worldwide hire him to assist with complex technology and business litigation matters in the US, Europe, Latin America, and Asia. 

Brian’s experience also includes anti-counterfeiting and e-commerce litigation, where he has obtained asset seizure orders, temporary restraining orders, and preliminary and permanent injunctions against numerous counterfeiters and copycats worldwide.

A registered Professional Engineer, Brian worked as a consultant and design engineer in Seattle, WA for seven years before becoming an attorney.

Experience

Led enforcement efforts against large-scale Chinese counterfeiting operation. Obtained a temporary restraining order, preliminary injunction, and asset freeze in litigation involving claims for copyright infringement and false designation of origin. Matter settled on favorable terms, including a payment to Bountiful Baby from the seized funds and entry of a permanent injunction. Bountiful Baby v. Reborn Baby World (D. Utah 2021).

Obtained arbitration award including attorneys’ fees in favor of The GiddyUp Group, Inc., after full arbitration hearing. GiddyUp Group, Inc. v. Green Bamboo, American Arbitration Association (2021)

Obtained temporary restraining order, preliminary injunction, and asset freeze in litigation involving unfair competition, trademark, patent, and design patent infringement claims. Successfully defended against various motions to dismiss before the matter settled on favorable terms including entry of a permanent injunction. The Neck Hammock, Inc. v. Danezen.com (D. Utah 2020).

Sought and obtained a preliminary injunction and asset freeze against sellers of counterfeit products in litigation involving claims of patent infringement, trademark infringement, and unfair competition. After entry of the injunction and asset freeze, the matter settled on favorable terms. The Neck Hammock, Inc. v. DurablePro (D. Utah 2019).

Jointly led litigation efforts with team from Orrick regarding claims for breach of contract. Obtained summary judgment in favor of OpenTV. Broadband iTV, Inc. v. OpenTV (California 2019).

Successfully defended (pro bono) a young woman against breach of contract claims brought by an organization perpetrating an illegal scheme to bring young women into China for unlawful “work” activities.  (Utah 2019).

Led patent litigation efforts on behalf of Kudelski SA, Nagravision SA, and OpenTV, Inc. against Apple Inc. in the United States, Germany, and China. After the first trial, obtained and enforced an injunction against the sale of Apple products in all of Germany. Enforced injunction through the seizure of products with customs in Germany. Matter settled on favorable terms. Nagravision SA v. Apple (Oberlandesgericht Düsseldorf 2016).

Led patent litigation and licensing activities on behalf of Kudelski SA, Nagra France SAS, and OpenTV, Inc., against Verizon Communications, Inc. resulting in a settlement on favorable terms. Nagra France SAS v. Verizon (E.D. Tex. 2015)
