Workman Nydegger Client Walker Edison Awarded Temporary Restraining Order

On March 28th the U.S. District Court for the District of South Carolina granted Walker Edison’s motion for a temporary restraining order against Gibson Living, Inc., Moda Flame, Inc., Elite Flame, and Artem Galperin.  Among other things, Walker Edison alleged the defendants had engaged in unfair competition and infringed Walker Edison’s design patents and copyrights.  The Court held that Walker Edison met its burden of a clear showing that it was likely to succeed on the merits at trial and that it had suffered irreparable harm.  Workman Nydegger Shareholder Dave Johnson stated, “Walker Edison is a true pioneer in the furniture industry, and the Court’s ruling affirms Walker Edison’s decision to protect its valuable intellectual property.”  Shortly after the Court entered the temporary restraining order the parties stipulated to a preliminary injunction.
