Overview on Information Disclosure Statement Practice

Information Disclosure Statements (IDS) are commonplace submissions under U.S. practice before the U.S. Patent and Trademark Office (USPTO).  They are filed according to the duty on all patent applicants to disclose prior art and background information that is relevant to the patentability of an applicant’s invention.  This presentation offers an overview on IDS practice including a discussion on ethical requirements and definitions, threshold questions and criteria for IDS, submission and timing requirements, and practical considerations.
