Workman Nydegger Represents Merit Medical in Trademark Victory

SALT LAKE CITY, FEBRUARY 3, 2016 – Workman Nydegger recently succeeded in obtaining judgment in favor of Merit Medical Systems Inc. (“Merit Medical”) in a trademark case filed in 2014 by Merit Healthcare International, Inc. dba Merit Pharmaceutical (“Merit Pharmaceutical”).

Merit Pharmaceutical sued Merit Medical in the U.S. District Court for the Central District of California for a declaratory judgment of no trademark infringement, and for cancellation of the “MERIT” and “MERIT MEDICAL” trademark registrations, as well as six other Merit trademark registrations.  After a year and a half of hard-fought litigation and three amendments to the original complaint by Merit Pharmaceutical, the Workman team, consisting of Brent Lorimer, David Todd, and David Johnson obtained a dismissal of the Third Amended Complaint and judgment in favor of Merit Medical.   “Our team is delighted to have obtained this result for Merit.
